Can I make an uninsured driver claim?
Uninsured driver claims can be made if you were injured in a road traffic accident as another driver, a motorcyclist, a cyclist, or a pedestrian. Claiming against an uninsured driver may also be possible if you were a passenger in the uninsured vehicle, provided you were not knowingly travelling in an uninsured car.
You can make a claim even if the driver who caused your accident had no insurance, or if they fled the scene and were never identified. Being injured through no fault of your own should not leave you without support, and the law provides a route to compensation through the Motor Insurers’ Bureau (MIB). This body was set up specifically to help people in this situation.
If the driver fled the scene and cannot be identified, you can still claim through the MIB’s Untraced Drivers’ Agreement.
According to the Motor Insurers’ Bureau, there are around 300,000 uninsured drivers on UK roads every day, and uninsured drivers are involved in 130 fatal crashes every year. The MIB exists to make sure those affected are not left to bear the financial burden alone.
Even if you are unsure whether your situation qualifies or if some time has passed since the accident, speaking to our solicitors can be helpful. We’ll talk you through your options, and tell you honestly whether you could claim compensation.
Example of an uninsured motorist claim
A motorcyclist is struck at a junction by a car that then drives away. The motorcyclist suffers serious injuries and misses months of work, but police are unable to trace the driver. Because the at-fault driver cannot be identified, a claim can be made through the MIB’s Untraced Drivers’ Agreement, covering injuries, lost earnings, and rehabilitation costs. The rider does not have to fund their recovery alone.

What compensation can help with
Covering your losses, whether the driver had insurance or not.
Compensation can cover a wide range of losses. When you process an uninsured driver claim, physical injuries can be serious, but claims also account for the psychological impact of an accident, the practical costs of recovery, and the financial effects of being unable to work. Whether your injuries are relatively minor or life-changing, every aspect of your losses deserves to be considered.
Compensation is about making sure you have the financial support to recover, rebuild, and move forward. Someone else’s decision to drive uninsured should not leave you out of pocket.
Successful uninsured driver claims may help fund:
- Physical injuries, from soft tissue damage to serious, life-changing harm
- Psychological trauma, including anxiety, PTSD, and emotional distress
- Lost earnings and future loss of income if your injuries affect your ability to work
- Medical expenses and rehabilitation costs
- Travel costs for medical appointments and specialist care
- Home adaptations or specialist equipment you need due to your injuries
- Vehicle repair or replacement costs
Understanding the potential value
We secured a £70,000 settlement for a 23-year-old client injured in a hit-and-run in Essex, where the severity of his injuries affected both his ability to work and his independence.
For more serious cases involving significant or life-changing injuries, settlements can be considerably higher. When we value your case, our specialist team will make sure nothing is overlooked. We have helped many clients secure settlements that reflect the true impact of their accident. We focus on both the immediate costs and the longer-term consequences.
Understanding interim payments
We understand that waiting for a claim to conclude can place real financial pressure on you and your family. This can be particularly difficult when your injuries are serious and care costs begin to rack up.
Where possible, we will seek to secure interim payments on your behalf during the claims process, before a final settlement is reached. This can help cover immediate costs such as medical treatment, rehabilitation, or adaptations to your home, so you don’t have to wait until the end of your claim to access support.

You're not alone
We understand what you're going through.
Finding out the driver who injured you has no insurance, or that they drove away and may never be found, can feel deeply unfair. On top of dealing with your injuries and recovery, you may be facing uncertainty about your finances, and how you will cover the costs of treatment and care. That pressure is very real.
Many of our clients come to us feeling overwhelmed.Often, they are unsure whether they have a case and feel apprehensive about the legal process. Our client, Janice, suffered a brain injury in a motorcycle collision that left her with difficulties walking and problems with her vision and memory.
We supported her through her claim and secured compensation that reflected the life-changing impact of her injuries. She now spends time caring for animals and pursuing her passion for ballroom dancing.
We have also supported a motorcyclist seriously injured in a hit-and-run who was left unable to work, and a delivery driver injured when a reckless driver fled the scene. In each case, the legal route felt uncertain, but we secured the compensation they needed to move forward.
That is what we’re here to do. We take on the complexity of the process, gather the evidence needed to support your case, and fight for compensation that truly reflects what you have been through. You should not have to face this alone.

FAQs about uninsured driver claims
How long do I have to make a claim through the Motor Insurers' Bureau?
In most cases, you have three years from the date of your accident to make a claim through the MIB. If you were under 18 at the time of the accident, the three-year period starts from your 18th birthday.
If you’re unsure whether you’re still within the time limit, speak to us as soon as possible. We will let you know where you stand.
What if the driver who hit me fled the scene and cannot be identified?
You can still claim compensation through the MIB under their Untraced Drivers’ Agreement.
Our team will gather the evidence needed to support your case, including witness statements, police reports, and any available CCTV or dashcam footage. The fact that the driver cannot be found does not mean you have no options.
How long does a Motor Insurers' Bureau claim take to complete?
MIB claims vary in length depending on the complexity of the case and the severity of your injuries. Some straightforward claims are resolved more quickly, while cases involving serious injuries or disputed evidence can take longer.
Our team works to move your claim forward as efficiently as possible, keeping you updated throughout.
Can I claim if I was a passenger in a vehicle with an uninsured driver?
As a passenger, you may still be entitled to claim compensation, provided you were not knowingly travelling in an uninsured vehicle.
The MIB will assess your case to determine your eligibility. If you’re unsure about your circumstances, we can advise you after a free initial consultation.
Can I claim if my accident happened in the UK but was caused by a foreign-registered vehicle?
You may be eligible for compensation through the MIB’s Green Card System. This system was set up to ensure victims of road traffic accidents involving foreign-registered vehicles are not placed at a disadvantage and can still receive the compensation they deserve.
Will I need to pay legal costs if my claim is unsuccessful?
No. We work on a ‘No Win, No Fee’ basis, which means you will not pay any legal costs if your claim is unsuccessful.
We believe that financial concerns should not stop you from claiming against an uninsured driver and securing the compensation you deserve.
What evidence is needed to support an uninsured motorist claim?
The stronger your evidence, the stronger your claim. Key evidence typically includes:
- A police report or incident reference number
- Witness statements
- Dashcam or CCTV footage of the accident
- Photographs of the scene and your injuries
- Medical records documenting your injuries and treatment
We will guide you through what is required and help gather everything we need to build the strongest possible case.
What support will I receive during my claim?
From your first conversation with us, we will handle every part of the process on your behalf, including all communications and negotiations with the MIB.
Where possible, our team can seek interim payments to help cover immediate costs during the claim. We will keep you informed at every stage, so you always know what is happening and what comes next.
