Can I make a product liability claim?

You may be able to claim if you’ve been harmed by a product, such as an implant, device or drug, that didn’t meet the safety standards you were entitled to expect. Unlike many other claims, you don’t need to prove anyone was negligent. You just need to show the product was defective, that the defect caused your injury, and that you were using it as intended.

Product liability claims are usually made against major manufacturers or pharmaceutical companies, and allow you to seek compensation for injuries caused by an unsafe product. Common examples of product liability cases we are actively pursuing include the use of; transvaginal mesh implants, metal-on-metal hip implants, orthopaedic implants, contraceptive injections, pacemakers, pharmaceutical medications.

What does a product liability claim entail?

What is a product liability claim?

A product liability claim is legal action you can take if a product, such as a drug or implant, caused you harm because it didn’t meet the safety standards the public is entitled to expect. These claims are usually brought against manufacturers or pharmaceutical companies, and they’re separate from clinical negligence claims because they focus on the product itself rather than how your treatment was delivered.

What do I need to prove for a product liability claim?

Claims are brought under the Consumer Protection Act 1987, which means you don’t need to prove negligence. Instead, you’ll need to show that:

  • The product was defective. It didn’t meet the level of safety reasonably expected
  • The defect caused your injury
  • You were using the product as intended
Are there time limits on product liability claims?

Yes. You generally need to start your claim within three years of discovering your injury was caused by the product.

There’s also a strict ten-year longstop limit from the date the product was first put into circulation, under the Consumer Protection Act 1987. If you’re not sure where you stand, get in touch and we’ll help you work out your timeline.

What might a manufacturer argue against my claim?

Manufacturers sometimes argue the defect didn’t exist when the product was supplied, or that it couldn’t have been spotted at the time given the scientific knowledge available. Compensation depends on how the product affected you, both physically and financially. It’s split into two parts:
