Can I make a gym accident claim?

You can make a gym accident claim if you suffered an injury in a gym, fitness class or leisure facility that was not your fault.

Gym accident compensation claims often involve things like; faulty gym equipment, slip hazards, poor instruction, free-weight accidents, crush injuries, unsafe areas, damaged floors, blocked walkways, poor lighting or poorly stored equipment that resulted in a trip or fall.

It’s our role to prove that your gym injury was the fault of the gym or leisure operator by showing they failed in their duty of care. That could mean it failed to maintain its equipment or you were given substandard safety information, and that led directly to your injury.

To find out if you have a claim, even if you think you were partly to blame, get in touch straight away. There are time limits on making claims, so make sure you contact us for a free initial assessment as soon as you can.

Example of a gym accident claim

An example might be that you were using a weights machine that hadn’t been maintained appropriately and the machine failed during use – causing a crush injury or soft tissue damage. If we can argue that the gym  failed in their maintenance checks, which directly led to your injury, this could be a valid claim.

The amount you can claim for a gym accident depends on how severe your injury was and how much impact it had on your life.

For minor gym accidents where you recover quickly, you’ll receive smaller settlement figures. More serious injuries pay much higher settlements to help cover the costs of recovery and the impact the injury has had on your life.

A successful gym accident claim could fund:

  • Follow-up appointments and treatment for your injury
  • Psychological support and counselling for the anxiety and distress caused
  • Loss of earnings if your injury has affected your ability to work
  • Travel costs related to hospital appointments and treatment
  • Care and assistance costs if your daily life has been significantly affected
  • General damages for pain, suffering and loss of amenity
Understanding the potential value

One of our clients slipped on chalk left on the floor and fractured his wrist at an indoor sports facility. Our team secured a settlement of £23,000.  No case is the same so the value of compensation awards for gym accidents varies.

Understanding general and special damages

You’ll receive two types of compensation if your case is successful. General compensation is payment for your pain, suffering and loss of amenity. Special damages reflect any financial losses you’ve experienced as a result of your gym injury. This includes missed earnings, treatment costs, travel expenses, care costs, rehabilitation costs, and future support needs. Hold on to your receipts, payslips, invoices and travel records, so your solicitor can include them in your final award.

FAQs about gym accident claims

Can I claim for a gym injury?

You may be able to claim for a gym injury if a failure in the duty of care by a gym or leisure centre caused you an injury. If you’re a gym employee who has suffered an injury, you may be able to make an accident at work claim.

How long after a gym accident can I make a claim?

There is a three-year time limit when making a gym accident claim. That’s usually three years from the date of the accident, or three years from when you first realised the accident caused your injury. There are exceptions, but it’s always better to start your claim as soon as you can.

How long does a gym accident claim take?

Less serious gym injuries where the gym or leisure centre admits its liability take a few months to settle. In more complex cases involving serious injuries where the other side doesn’t admit liability, these can take two to three years to settle.

How do I start a gym accident claim?

Start by contacting Fletchers for a free initial assessment. We’ll ask what happened to you, where it happened, and what injury you suffered when you get in touch. We can often start gym accident claims within days of you contacting us.

Do gym accident claims go to court?

Some claims involve court proceedings if the other side denies liability or they do not agree the claim value with us. Your solicitor will explain each stage and guide you through the process.

How much does it cost to make a gym accident claim?

With Fletchers, there is no financial risk to you or any need to find money up-front. We handle all gym accident claims on a “No Win, No Fee” basis. That means you only pay us an agreed percentage of your compensation if we’re successful. If we’re unsuccessful, you don’t pay a thing.

Your initial assessment is free too, so checking whether you have a strong claim or not costs you nothing.
