Incident details:
Fletchers Solicitors acted on behalf of our 24-year-old client who was cycling along an A-road when he was involved in a road traffic accident (RTA). 

Our client was cycling correctly when he approached a roundabout. While using the roundabout properly, the defendant driver pulled out from a side road, colliding with our client and knocking him off his bike. 

Injuries and impact: 

Being knocked off your bike by a car is a frightening experience for any cyclist; the sudden impact can feel like a shock. In addition to this challenge, our client sustained physical injuries:

• Fracture to the wrist: Our client had a recovery period of 9 months from this injury and had to take 3 months off work due to the heavily manual nature of his job.

• Soft Tissue Damage to Hip 

• Various cuts and grazes to his body. 

Legal support and outcome:

This claim was processed through the Ministry of Justice (MOJ) claims portal. MOJ claims have a maximum compensation cap of £25,000 that our client could receive. 

The MOJ Portal is designed for processing lower value personal injury claims, including those from road traffic accidents. It aims to streamline the claims process and result in a quicker resolution.

However, with this case, an initial agreement could not be reached during the Stage 2 negotiation process with the defendant’s insurers. Dave Gardner, the personal injury solicitor on this case, then proceeded to take the case to court for a Stage 3 hearing. 

At the hearing, which was in person at Court, Dave made his submissions to the Judge which were necessary to secure the award.  The Defendant’s appointed Barrister made their own submissions which Dave was able to argue successfully against. The Judge saw the merits in our submissions and made the award sought in our client’s favour. We successfully secured a higher compensation for our client.

A further success for our client was being awarded gratuitous care, which is compensation for the care and assistance provided by a family member or friend. Our client received help and care from his partner for six weeks as he recovered from his injuries.

Our client, an employee of a well-known British airline, was training a new member of staff on the tug (a vehicle used to transport luggage around an airport) when the trainee ran over our client’s foot, causing injury.

Compensation for trip and fall in children’s playground

Incident details:

Our client was collecting their daughter from school when staff asked her to enter the garden area where her daughter was enjoying playing. As our client was walking through the garden area to collect her daughter, her left foot tripped over a tree stump that was hidden by grass, causing her to fall forwards and sustain an injury.

As this incident happened in an area designated for children to play, it highlighted a safety concern for young children who could also potentially trip over the hidden tree stump and potentially sustain a worse injury.
