Settlement: £10,768.75
Lawyer: Josh Whittam

Case Overview:

Our client was involved in an incident at an event organised by a well-known venue in Alnwick, Northumberland. While attending an evening light show, our client was walking along a path, which had been darkened to enhance the effects of the event. Guide ropes were in place to assist visitors, but as he attempted to pass other visitors, he fell into a gap where the guide rope cut across a drop in the path.  This resulted in him to falling forward and hitting his head on the edging of the pathway.

Injuries and Impact:

The client sustained a head laceration, scarring, and soft tissue injuries to the neck.

This had a significant impact on our 72-year-old client, as a head injury can lead to serious complications and is often very concerning for those involved. The client required immediate medical attention, and the family outing was unfortunately disrupted due to the incident.

Legal Support and Outcome:

The case was handled by personal injury lawyer, Josh Whittam, and was based on the premises being unsafe for visitors, leading to a public liability claim.

Liability was accepted and resulted in £10,768.75 compensation for our client.

£2,500 Settlement for Chemical Burns in Employer’s Liability Claim

Settlement: £2,500
Lawyer: Josh Whittam

Case Overview:

The client, employed as a Kitchen Porter at a Garden Centre in Burscough, suffered chemical burns at work after using an incorrectly diluted chemical cleaner as part of his day-to-day job. The cleaners main use is for the removal of tea and coffee stains from crockery.

Injuries and Impact:

The client endured significant chemical burns, leading to peeling skin and ongoing pain that affected his daily activities at the time.

The injuries were caused by inadequate safety precautions and lack of proper training regarding the handling of hazardous chemicals in the workplace.

Legal Support and Outcome:

The client moved forward with an employer’s liability claim, and with John Josh Whittam managing the case, he pushed for a claim against his employer as they had a duty to ensure he was safe at work and fully equipped to take on his day-to-day tasks safely. Employers are required by law to ensure that hazardous substances are properly managed, and that staff are adequately trained and equipped to handle such materials. The Health and Safety at Work Act and COSHH (Control of Substances Hazardous to Health) regulations require employers to:

  • Conduct risk assessments: to identify hazardous substances, emergency procedures from spillages and leaks, and define how the chemicals are used in the workplace

  • Prevent or Control Exposure: such as providing PPE, like gloves and aprons

  • Provide training: to employees on how to handle chemicals safely, and regularly monitor this usage

  • Implement safety procedures: such as identifying emergency procedures for spillages, leaks and to avoid accidents like the one the client experienced

Our client’s employer failed to comply with these regulations, which directly contributed to the client’s injuries. As a result, the case led to a successful compensation of £2,500.
