The incident

Our client, a 60-year-old man, was travelling by motorbike in the centre of his lane, when the defendant pulled out from a side road, causing a collision. He suffered the following injuries:

    Spinal injury

  • Fractured humerus
  • Fractures to the forearm and wrist
  • Hand injury, including fractures to the base of 1st metacarpal and base of 5th metacarpal
  • Broken hip and broken thighbone
  • Left tibial plateau fracture
  • Right anterior 6th and 7th rib fractures
  • Spinal injury with T3 and T4 fractures
  • C2 lateral process fracture
  • Developed hospital acquired pneumonia
  • Developed acute carpal tunnel syndrome right wrist
  • Psychological trauma

The case

The client was represented by a Fletchers Chartered Legal Executive, supported by Paralegal, Georgia Catherall.

During the case, surveillance video footage of the client was disclosed by the defendant in a bid to undermine our client’s injuries. However, our expert remained of the opinion the footage simply proved our client was presenting in a way that was entirely appropriate.

The aftermath

Following the motorbike accident, the client experienced degenerative changes in his right knee. He also reported psychological symptoms and fatigue upon his return to work.

Prior to the accident, our client had been in a skilled manual job for 35 years, but due to physical limitations after the collision, he was limited to administrative tasks. Our client was made redundant from his usual employer in September 2022 and because of the accident, our client is considered permanently disadvantaged on the open labour market.

Before the accident, he was also the sole carer for his wife, carrying out all heavy manual domestic tasks. As a result of the accident, he became restricted in helping with household tasks involving the use of his right hand.

The case outcome

Through the hard work of our legal team, a final compensation figure was achieved of £454,000.
