Cyclist knocked off bicycle by parked uber eats driver

The incident 

Our client had been cycling along the road safely, when he was suddenly knocked off his bike by a parked Uber Eats delivery driver. The driver had opened his door in the path of our client and attempted to exit his vehicle without looking. This had caused our client to fall off his moving bike. Due to there being a protest at the time, the police were already present in the area and witnessed our client’s fall. 

The aftermath 

Our client was taken straight to the hospital, as he suffered severe injuries in the collision. He had suffered a fracture to his right humerus, and other soft tissue injuries to his right shoulder. Our client remained in hospital for over six hours, in order to get the right treatment for his injuries. 

Though our client did not take any time off work, his work was impaired due to his injuries, and he was advised it would take 6-8 weeks for him to heal completely. This also meant he was not able to continue with his cycling during this time, and had to refrain from his hobby to accommodate the healing process. 

The case 

The case was handled by solicitor, Dave Gardner. As police had attended to the incident, we ensured that we obtained all the relevant evidence from them, in order to investigate the incident. The police provided all relevant information on the incident and the driver; as well as all police reports on the matter. 

A claims notification form was sent to the defendants in October 2023. We also received a response from them admitting fault for the incident, and offering our client physiotherapy sessions for his injuries. Our client was happy with this as he was able to begin physiotherapy sessions right away. It also meant all that was left to decide was the amount of compensation he was entitled to for his injuries and losses. 

Our client was also sent for a medical consultation with an orthopaedic consultant, who helped assess his injuries and provided a prognosis. 

The case outcome 

The claim was finally settled for £11,500. Initially the defendants had proposed a lower figure, but we argued our client’s case and ensured we received the settlement we believed our client deserved. With some negotiation and reasoning we were able to get the final figure we wanted. This allowed the client to pay for any necessary adjustments he needed to make.
