Incident details:

Our client was at work at a railway station mess room, when he went over to a pedal bin to dispose of some rubbish. Due a dip in the floor, caused by rotten floorboards and uneven flooring, the client lost his balance, causing him to fall and twist his ankle.  

Injuries and impact:

The client suffered an injury to his left ankle & and exacerbation of left knee pain. He also suffered depressive disorder and anxiety. The client needed help from his family for a period after the accident and is undergoing physiotherapy.   

Legal support and outcome:

The matter was initially pursued as a workplace accident claim against the client’s employer, a security company. However, it was later advised that the claim should be redirected to the property owner responsible for the premises. 

The occupiers’ liability claim was managed by Litigation Executive James Hammond, who successfully resolved the case. The railway company accepted responsibility for the unsafe condition of the mess room floor and admitted full liability. The client was awarded £15,000 in compensation.

Incident details: 

Our client, a 56-year-old company director, had been for a late appointment with her GP. Once her appointment finished, she had to exit the surgery via the side emergency exit, as the front doors had been locked. 

The client opened the door and turned to the right to walk over to her car when she tripped over a ramp from the side. The client couldn’t see the ramp, as the lighting outside the emergency exit door wasn’t working. The client tripped and fell forward onto her knees, resulting in injury.  

Injuries and impact: 

The client sustained a deep cut to her right knee, as well as pain and bruising. She also suffered some minor grazing to her left knee and both hands.
