Client was given no PPE and suffered an accident at work
The incident
The claim involved our client having an accident at work where they were not supplied with PPE (personal protective equipment).
Whilst they worked as a machinist at Comfort First Limited, our client was cutting a memory foam mattress and slipped with the machine. Since they had not been provided with any PPE, they suffered injuries as a result.
Our client’s injuries included a deep cut to their left index finger, which required surgery to deep-clean the wound. However, the wound didn’t heal which led to their finger needing to be partially amputated (to the joint at the tip of the finger).
The aftermath
Unfortunately, the wound did not heal correctly, and became infected with MRSA, requiring our client to have further deep cleaning of the wound. Further to this, they then developed painful nail re-growth after a few months, which eventually led to this nail regrowth needing to be surgically removed.
These injuries and complications have left our client with ongoing pain when the tip of the amputation stump is knocked, or during cold weather, as the tip is now hypersensitive.
Furthermore, our client’s mental health has also suffered as a result of the accident, leading to a Chronic Adjustment Disorder with mixed anxiety, depression and post-traumatic stress.
The case
The case was handled by employer public liability solicitors, Victoria Martin and Katie Rutter; both part of our dedicated practice, Serious Injury Law. Both solicitors on the case worked hard to ensure our client’s rehabilitation needs were met to help them in recovery. Fortunately, our client benefited from the treatment provided, and has been able to return to doing things they loved before the accident, including spending time with their two young children.

The outcome
The client received a settlement of £110,000 to recompense for the pain and suffering they endured following their accident in the workplace. The client no longer works for Comfort First Limited, or in a manufacturing position, but now works part-time in both a bar and at a school.
