£890,000 in interim payments secured after medical negligence results in brain injury

Our expert medical negligence team obtained £890,000 in interim payments enabling a man with a brain injury following medical negligence to move forward with his housing options

The case

Nina Taylor and Chloe Mead have so far secured interim payments amounting to £890,000 for “Richard”, a 58-year-old male who suffered a brain injury and neurological decline as a result of the defendant’s admitted failures.

Richard said “the interim payments will enable me to begin the process of finding a more suitable property that will make a huge difference to my life.”

Following substandard care by the Plastic Surgery team at the NHS Countess of Chester Hospital in 2018, the Defendant subsequently admitted that a delay in a referral and/or urgent surgery led to Richard suffering an avoidable infection. As a result, he sustained a life-changing brain injury and he is now a full-time wheelchair user and has lost the use of one arm.

Fletchers Solicitors have secured a series of interim payments to fund pivotal rehabilitation and support for Richard. His multi-disciplinary therapies have been instrumental in improving his quality of life. Securing ongoing interim funding has been vital to ensure continuity of care and to retain the multidisciplinary team without the worry of running out of funds.

Court proceedings have commenced in the High Court as a resolution to the claim has not yet been achieved. An interim payment for £550,000 has recently been obtained to enable Richard to acquire suitable accommodation. He is now in the process of looking for a property which can then be adapted to suit his needs.

Partner and Head of the Brain Injury Unit at Fletchers Solicitors said “this case is another demonstration that securing interim payments in clinical negligence claims is essential; not only to provide financial support to maximise rehabilitation, but to give people the opportunity to try and begin re-building their lives as soon as possible. Through teamwork and dedication to supporting our clients, we are pleased that funds are now available to properly investigate Richard’s housing options.”
