Our Serious Injury team secured £25,000 compensation for an injured pedestrian in a pedestrian accident compensation claim after being knocked over by a taxi at a pelican crossing.

The day of the accident:

Our client, a retired man in his mid-70s, was out for a walk in his local area. He was crossing the road at the pelican crossing of a side road when a taxi driver turned into the road, knocking him over.

The wife of our client was the one to receive the call that he had been in a road traffic accident. When she arrived at the scene, she remembers seeing her husband lying on the floor. Understandably, this was quite traumatic for her.

How we managed this pedestrian road accident claim

The case was submitted via the Ministry of Justice (MOJ) portal. Initially, the insurers did not respond, citing ongoing enquiries. The case eventually fell out of MOJ.

The case had a potential risk of dispute from the defendant’s side, as our client was genuinely unsure whether he had pressed the button at the pedestrian crossing and could not remember whether he was crossing on a green man. We were able to seek witnesses who were present, but they too were unable to confirm this. This meant there was a risk the defendant might argue our client crossed unsafely.

We pursued our client’s pedestrian injury claim and obtained and submitted additional witness evidence to strengthen his position.

Eventually, the taxi driver admitted liability and made an early settlement offer of £10,000. However, at this stage, we were awaiting the client’s independent medical report, and our goal was to ensure the settlement reflected the full impact of his injuries. Accepting the early offer could have risked the client not receiving the maximum compensation he was entitled to.

On receipt of the medical report, we confirmed that our client’s injuries caused a significant acceleration of his pre-existing knee and elbow conditions, alongside a new lower back injury. His mobility and fitness, previously maintained through daily walking and cycling, were also affected.

Following this evidence, the defendant increased their offer to £15,000, which was rejected, leading to our legal team issuing a Part 7 proceedings. A Part 7 is used to formally start court proceedings when negotiation through the MOJ portal is not progressing. Issuing Part 7 protects our client’s rights and increases pressure on the defendant to make a more realistic settlement offer.

The case then saw subsequent rejected offers, and we pressed forward with a formal proposal to settle the claim under the Civil Procedure Rules, known as a Part 36 offer. Our proposal of £25,000 was accepted by the defendant, and the case settled out of court.
