Successful personal injury settlement for FedEx motorbiker

The Incident  

Our client was riding his motorcycle along the A48 in Cardiff to work when the defendant crossed the road without giving way, causing a serious motorcycle accident. He felt an immediate impact on his right side and landed forcefully on the ground. An ambulance arrived at the scene, examined him, and took him to the A&E department at University Hospital of Wales, where he underwent emergency surgery for his injuries.

The Aftermath 

Our client sustained a fracture to his right leg calf. Our client also suffered deep cuts to his calf and heel. 

Our client needed to have surgery to stabilise and repair his broken leg. He also needed a vein graft for a damaged artery in his ankle, as well as a repair of one of his tendons at the same time.  

On occasion our client will use a wheelchair when he struggles with his mobility. At home he will mobilise with crutches or a wheeled Zimmer frame. 

The incident had a physical as well as a psychological impact on our client that it left him feeling depressed and extremely anxious.  

Prior to their motorcycle accident, our client lived a very independent and fulfilling life, however due to the nature of his leg injury, and following a functional capacity assessment he is unable to return to his previous occupation as a delivery driver for FedEx. He is capable of some part-time employment as long as it is sedentary. Our client will never be able to work in the same role, or on a full-time basis again. 

The Case 

Senior Solicitor and Team Leader, Victoria Martin along with Solicitor, Dale Bickerstaffe took on the case, assisted by Katie Rutter. Upon receipt of the allegations, primary liability was admitted early in the case. 

Although a primary admission of liability was made, further investigations were made to consider the possibility of any contributory negligence against our client. Appropriate expert evidence was obtained to support liability in our client’s favour. 

The Case Outcome 

Our client’s case was settled for a total amount of £425,000.  The sum included interim payments received throughout the duration of his case. The settlement will allow our client to regain some of his pre-accident independence and it will take some of the financial strain away from his wife, as he was unable to go back to work whilst he was in recovery. 

Upon reflection, the lead solicitor on this case commented ‘It was a pleasure representing our client. It is unfortunate that due to his injuries he can no longer work in the industry he enjoyed being part of, however it is reassuring to know he now has the financial security needed which will give him the flexibility to work in whatever capacity he chooses.’
