Successful accident at work settlements for our Employers’ Liability team

Man receives compensation following fall due to unsecure duckboard at work

Our client was standing on a duckboard and was preparing himself to work on the electronic CNC machine, when the board slipped away from under him. He tried to grab hold of the drill to stop his fall, however this resulted in him injuring himself. He cut his hand and now has a scar. 

This case was handled by Samantha Cummings, Chartered Legal Executive. Samantha argued that the defendant should have provided a workspace that was reasonably maintained; and also, that they did not assess risk of injury caused by the unsecure duckboard. 

The defendants accepted that they were negligent and sent an offer for our client to consider. This offer was accepted by Samantha following a conversation with the client. This avoided the need for negotiations or further discussions to value the client’s claim. With such a quick resolution, our client was able to put behind this ordeal.

During the course of his employment, our client was injured whilst drilling into metal bearers. As he put his hand out to support his weight, the drill slipped and went into his hand. Our client sustained a deep tear and puncture wound on his left hand. He is also left with a permanent scar.

Upon further investigation it was revealed that our client had never been properly trained on how to do this task, and that he had been relying solely on his own experience. Lucy sent over the client’s allegations to the defendant, who admitted liability upon receipt.  

This case was settled in our client’s favour, for the sum of £2,192. When asked about his experience with Fletchers, our client described the service he received as ‘perfect’ and would ‘definitely recommend to family and friends.’ 

Man receives compensation following wrist injury at work

Whilst at work, our client was moving a door from a lorry with a colleague. As they lifted the door off, he felt a ‘pop’ in his left wrist. This resulted in our client sustaining an overstretched tendon. 

This case was handled by Lucy Ashbrook, Litigation Executive. It was argued that our client should have been assisted with more workers or machinery equipment to remove the door.  

Allegations of the defendant’s negligence was sought, and they admitted liability on receipt. We were able to obtain a favourable outcome for our client, in the sum of £4,251. Upon reflection, Lucy stated that ‘it was a pleasure’ to work on this case for our client.
