Settlement Secured After Care Home Kitchen Assistant Injury

The Incident 

While working as a Kitchen Assistant in a care home, our client experienced an unfortunate accident. She was pulling a food trolley when its handle came off, causing her to fall and sustain an injury to her back.

Injuries Sustained 

 During our investigation into the incident, an Orthopaedic expert said that there was not enough information in the initial medical records available, so a MRI was required to assess the injuries. It was found that accident aggravated our client’s pre-existing back pain. The expert determined that the incident was responsible for 50% to 66% of her initial pain. They also anticipated that symptoms would resolve within 3 to 6 months following the accident. 

After receiving the MRI results, the expert’s Addendum report confirmed their initial opinion: any ongoing pain beyond this period was attributed to her pre-existing condition, not the workplace accident. 

Due to her injury, our client initially struggled with daily chores and required assistance from her daughters to manage her household tasks. In addition, she had to take some time off work as a result of the accident.

The Case 

Following the accident, the client reached out to Fletchers Solicitors for support. Experienced Litigation Executive Justine Murtagh took on her case. 

During negotiations, the defendant’s insurer advised them to admit liability for the incident.

The Outcome 

Justine successfully secured a settlement of £2,575.03 for our client, despite the defendant did not admit liability within the Ministry Of Justice claims portal. This provided her with much-needed resolution and recognition for the hardship she endured. 

This settlement was able to helped our client secured lost earnings and travel expenses.
