£50K settlement achieved for passenger injured in RTA

The Incident 

On 6th June 2020, our client was a passenger in a vehicle that lost control when turning due to bad weather conditions. The road was extremely wet and slippery. 

The defendant, who was our client’s partner, was travelling along the bridge on Clifton Road in Rugby. The defendant was approaching a slight bend in the road. The defendant ended up in the opposite lane heading towards oncoming traffic. The defendant then impacted another vehicle, which was travelling in the correct lane.  

Our client was sat in the back behind the front passenger seat. She ended up slamming into the seat in front of her, due to the impact she damaged knee and hit her teeth on the headrest.  

The Aftermath 

Due to this incident, our client unfortunately sustained a number of injuries. 70% of our client’s knee ligament was torn. They also suffered with a chip of their enamel tooth as well as a scar on her lip. Our client also had soft tissue damage to her chest and her lower abdomen. As a result, our client required several surgeries and extensive treatment. She had to take five months off work as a self-employed cleaner. This impacted her financially because she was out of work. She also suffers from headaches now following the accident. 

The Case 

This case was handled by Claire Phillips, Litigation Executive. Following our Letter of Claim the defendant’s liability was accepted in August 2023. The defendants made an offer of £25,000, however, at the time, Claire identified that our client’s injuries were much worse, and we needed medical evidence to support our claim.  

The Case Outcome 

Following receipt of the medical evidence we were able to settle the case for £50,000 almost doubling the initial offer. She hopes to be able to use this money to overcome her anxiety of being in cars and complete her driving lessons. Before this accident, our client was an avid footballer and enjoyed going to the gym. She hopes to be able to get back to these activities now that the case has settled.
