MEDICAL NEGLIGENCE

Justice secured for family following tragic death caused by premature hospital discharge

At Fletchers Solicitors, we understand that behind every medical negligence claim is a family whose life has been turned upside down. This case was especially heart-breaking, it involved the untimely death of a much-loved 52-year-old husband and father who had been in good health before a series of avoidable medical errors changed everything.

The Incident

Our client, was a devoted husband and father of three who had built a happy and stable life with his family. When he was admitted to hospital with severe community-acquired pneumonia, it was naturally a worrying time for his loved ones. However, they trusted the medical professionals treating him to provide the care he needed to recover.

Although our client’s condition was serious, his family believed he was in safe hands. In the days that followed, the hospital staff decided that his health had improved enough for him to be discharged. Yet crucial warning signs were ignored, he still required oxygen to help him breathe, and his blood test results remained abnormal.

Despite these red flags, he was sent home. Within days of his discharge, tragedy struck, our client’s condition deteriorated rapidly, and he passed away. His sudden death left his wife and children devastated, struggling not only with overwhelming grief but also with the practical and financial challenges of losing the family’s main breadwinner.

Proving Negligence and Accountability

Our client’s family came to our experts seeking answers. They had trusted that his doctors would provide appropriate care, but their instincts told them something had gone terribly wrong. We launched a thorough investigation, working closely with independent medical experts to review every step of W’s treatment.

A Consultant in Acute Medicine provided expert evidence confirming that the hospital had failed our client in two key ways:

  1. He had been discharged prematurely, despite his reliance on oxygen and abnormal blood results.

  2. His treatment plan was changed from intravenous antibiotics to oral antibiotics too soon, a decision that left him vulnerable to deterioration.

Further expert analysis concluded that, had our client remained in hospital and received appropriate care, he would have survived. These findings provided the family with the validation they needed: their instincts had been correct, and our client’s death was preventable.

The Settlement

Armed with expert evidence, we built a strong case that held the hospital to account for its failings. The hospital ultimately admitted liability, and we secured £315,000 in compensation for our client’s family.

This settlement reflected the devastating impact of losing a husband and father. As our client had been the primary breadwinner, his sudden death left the family facing significant financial insecurity at an already incredibly difficult time. The compensation has helped provide stability, ensuring that his wife and children have the financial support they need for their future.

While no amount of money can ever replace the presence of a beloved family member, this settlement brought a measure of justice and recognition for the harm caused. It also helped the family begin to rebuild their lives, knowing that their voices had been heard and their loss acknowledged.
