Compensation Secured After Botched Gastric Bypass Surgery

The Incident 

In 2022, our client consulted with Mr. S. J. Robinson at Burcot Hall Hospital in Bromsgrove to explore weight loss surgery. Opting for a gastric bypass, the surgery was arranged through Transform Hospital Group. 

A year later, the client underwent laparoscopic surgery under general anaesthetic. After more than 2.5 hours in surgery, the procedure was deemed complete, and the client was moved to recovery. However, the surgeon later discovered that the final stage—division of the bowel—had not been performed. 

After consulting a senior surgeon, the decision was made to return the client to theatre for a second laparoscopic procedure under another general anaesthetic. The error led to two surgeries in rapid succession. The client was discharged the next day. 

The Injuries 

As a direct result of the surgeon’s error, our client experienced: 

• A second laparoscopic procedure. 

• A second general anaesthetic. 

• Worsening mental health conditions. 

• Prolonged recovery with ongoing pain and suffering. 

• Increased risk of future physical complications. 

The Impact

The aftermath of these surgeries significantly affected our client’s life: 

• Physical Impact: Recovery was prolonged, requiring family support for basic activities like moving around to prevent blood clots, using the toilet, and shopping. For 6–8 weeks, she was unable to perform household tasks independently. 

• Mental Health Impact: The client suffered high anxiety and depression during her recovery. Lack of sleep and persistent pain curtailed her once-active social life. She was prescribed medication to manage anxiety. 

The Case
