Case Study – The EyeCee One Lenses Litigation
As we continue our Group Action Week series, today we turn to the EyeCee One lenses litigation. Fletchers Solicitors is representing patients who have suffered due to faulty intraocular lenses used in cataract surgeries. These patients are seeking justice after the Medicines and Healthcare Products Regulatory Agency (MHRA) raised concerns over the safety of EyeCee One and EyeCee One Crystal preloaded lenses, leading to a recall.
The Background
The EyeCee One lenses, manufactured by Nidek, were widely used in cataract surgeries between September 2021 and November 2022. However, it was later discovered that a coating used in the injector device used to administer the lenses obstructed natural drainage pathways in the eye, causing an increase in intraocular pressure (IOP). If untreated, this elevated IOP can lead to permanent eye damage, including loss of vision.
A field safety notice issued by Nidek in July 2023 prompted the recall of the affected lenses, with up to 4% of patients experiencing complications. NHS England followed this with a patient safety alert, urging trusts to recall patients who had received these lenses and to offer urgent treatment for those showing signs of raised IOP. Overall, 30,000 lenses were on the list.
Around 20 NHS Trusts suspended the use of these lenses, with some, such as Hull University Teaching Hospitals Trust, recalling hundreds of patients for checks. The issue has impacted a significant number of people, and Fletchers Solicitors is now acting on behalf of many patients whose lives have been severely affected by these defective lenses.
After being made aware of the first Field Safety Notice, we commenced a localised publicity campaign via Social media and our website with a view to raising awareness of this issue and capturing any potential clients. As a number of clients were less technologically minded and / or unaware of the issues with their lenses it was a relatively slow process to build this group.
The Impact on Patients
Two of the clients Fletchers Solicitors is representing include SM and John Stabler. Both individuals have endured pain, uncertainty, and a loss of quality of life as a result of the faulty EyeCee One lenses. Their stories highlight the real-world impact that a faulty medical device and treatment can have on individuals and their families.
SM’s Story
SM, one of our clients, experienced raised intraocular pressure in both eyes following cataract surgery that involved the use of EyeCee One lenses. While his pressures have since been controlled, he continues to worry about the long-term impact on his vision. Though SM has not suffered permanent damage, he fears for his optic nerve and the potential consequences of uncontrolled pressure in the future. The pain and discomfort he experienced before his pressures were stabilised have left a lasting emotional toll, and the uncertainty about what may come still weighs heavily on his mind.
SM’s case is ongoing. His experience is a reminder of the anxiety and distress that often accompany medical issues, even when physical damage is not immediately apparent.
John Stabler’s Story
John Stabler’s story, featured by the BBC, highlights the extreme consequences that can arise when complications from faulty lenses go untreated. John, who underwent cataract surgery at Hull and East Yorkshire Eye Hospital in October 2022, suffered catastrophic nerve damage in his left eye due to the raised IOP caused by the EyeCee One lens. Just days after the surgery, John was in unbearable pain, describing it as feeling like being hit with a sledgehammer.
The impact on John’s life has been profound. He now has blurred vision in his left eye, which he describes as being like “looking down a straw,” and he has lost his HGV licence as a result of his impaired sight. The injury has also had a devastating effect on his business, with turnover falling by 70% to 80% due to his inability to work at full capacity. John’s wife, Amanda, shared how heartbreaking it has been to see her husband struggle in the weeks and months following the surgery, from constant pain to difficulties with mobility and coordination.
John is now part of the group action seeking compensation from Nidek, alongside at least 19 other patients who have been affected by the faulty lenses. His case, like many others, serves as a stark reminder of the severe and life-changing consequences that can result from medical device failures.
