Jess’s Rule – A New Dawn in GP Accountability and Patient Safety

The British Government and NHS rolled out a landmark new patient-safety initiative known as Jess’s Rule, named in memory of Jessica Brady, a 27-year-old who tragically lost her life to cancer in December 2020 after more than twenty GP appointments failed to identify her disease until it was too late.

What Led to Jess’s Rule?

Jessica Brady’s case has become symbolic of something many patients fear, seeing their concerns repeatedly dismissed or treated lightly, even as symptoms persist or worsen. In her case, despite numerous visits, nothing definitive was concluded until she sought private care, only to be diagnosed with cancer, which by then had become incurable. 

Jess’s family campaigned tirelessly for change. Their efforts, along with support from  the public, medical institutions, and policymakers, culminated in Jess’s Rule now being enshrined into NHS practice across England.

What Jess’s Rule Means for Patients Going Forward

Jess’s Rule introduces a formal “three strikes and rethink” obligation for GPs. The core of it is this: if after three appointments a GP has not been able to offer a substantiated diagnosis, or if the patient’s symptoms have escalated, they should pause, review and reconsider whether the current diagnosis is correct, and reassess what else might be going on.

Key changes and protections include:

  • Earlier detection of serious illnesses, including cancers, especially in younger patients or those from ethnic minority backgrounds who may otherwise face delays.
  • Formalised guidance so that GPs are supported (not just left to intuitive judgement) to reflect, seek second opinions, conduct more thorough examinations, or initiate specialist referrals when necessary.
  • A reduction in health inequalities: Jess’s Rule aims to ensure that patient age, background or ethnicity do not become barriers to getting earlier and accurate diagnoses.

How Jess’s Rule Should Reduce Misdiagnoses

Misdiagnosis and delayed diagnosis often happen because symptoms are vague, because changes are gradual, or because early encounters are attributed to more common, less serious causes. Jess’s Rule combats this by:

  1. Forcing a review point: After three appointments without improvement or with worsening symptoms, there must be a rethink. This helps stop the drift of assumption and inertia.
  2. Encouraging escalation: More diagnostics, specialist referrals, or second opinions become part of the expected process, not exceptional.
  3. Strengthening continuity of care: GP practices will be encouraged to ensure patients are followed up properly; that previous remote or superficial assessments are reconsidered in favour of more thorough face-to-face, physical examinations etc.

All of this is hoped to lead to fewer patients suffering because their serious conditions were missed until it was too late.

“I am genuinely optimistic that this will make a difference for patients and reduce the tragic cases of delayed diagnosis that lead to a fatal or life changing outcome.  Frequently patients see a different GP every time they have an appointment at their  surgery.  In many of the medical negligence cases I see against GPs, there is a failure to take charge of the situation and appreciate that this patient has returned numerous times to the surgery, their condition is deteriorating, (or at least not improving) and that they do not have a diagnosis.  It will be interesting to see what impact this rule has on GP behaviour and ultimately what impact it has on the diagnosis and treatment of critical illnesses.  Anything that increases the chances of timely assessment and treatment has to be welcomed as a positive step for patient care.”
