Woman wins High Court claim go-ahead over vaginal mesh implant

Last week the High Court ruled to allow a woman to pursue a claim for clinical negligence against a deceased surgeon, over injuries sustained as a result of a vaginal mesh implant.

A lawyer within our medical negligence department, commented on the recent article “The ruling found in favour of the patient’s right to pursue a claim, in respect of an appeal lodged by the deceased surgeon’s estate, who contended that the claim could not proceed as the surgeon had died before being made aware of the claim and as it was outside of the limitation period. The recent controversy over the use and safety of the vaginal mesh implant and influx of recent claims concerning the product has been widely reported in the media.”
