Closure Achieved for Our Client After Inadequate Maternity Care at Pinderfields Hospital
Our client sought our legal advice after suffering inadequate medical care at Pinderfields Hospital in West Yorkshire. During the birth of her first child, our client suffered a traumatic birth and substandard postpartum care.
Whilst giving birth at Pinderfields Hospital, she was given an episiotomy without the use of anaesthetic. This caused her severe pain and distress, leaving her with lasting psychological scars. Our client requested pain relief and unfortunately experienced two failed epidurals. Consequently, a decision was made to perform an episiotomy without any pain relief. Our client does not recall consenting to this, nor were alternatives discussed with her. Our client was given no further pain relief whilst undergoing stitches, despite communicating that she was experiencing unbearable pain. This traumatic experience led our client to suffer from PTSD postpartum, causing her to have vivid nightmares reliving the event and physical symptoms such as night sweats.
Before being discharged from hospital, our client expressed concerns that her stitches were breaking down. A midwife examined her and noticed there were early signs of wound breakdown, despite this our client was discharged. Once recovering at home, a community midwife visited and observed that she had a perineal wound dehiscence, which is when the episiotomy stitches fail. This caused her further pain and distress and put her at risk of infection. She was seen by a registrar and sent home with antibiotics, our client had to visit Pinderfields Hospital three times over one weekend before she was finally readmitted for surgery, meaning she was away from her newborn baby at a critical time in the bonding period. That weekend, while she was awaiting surgery on Monday, caused her a lot of emotional stress. She felt terrified of moving, using the stairs, and getting out of bed.
This case is part of a troubling pattern of substandard maternity care at Pinderfields Hospital, highlighted in a recent internal audit. The audit revealed that dozens of women were not given the appropriate aftercare treatment, such a urogynaecological and physiotherapy, at Pinderfields Hospital between 2020-22.
Emotional and Psychological Impact
This personal experience highlights the emotional and physical toll of inadequate maternity care. As a result of her experience under the care of Pinderfields Hospital, our client’s mental health suffered. She received minimal postpartum aftercare, which can exacerbate these struggles. The distress our client experienced during childbirth and early postpartum led her to opt for an elective caesarean section for her second child, as she felt fearful of another natural birth. The absence of compassion and follow-up care in this case contributed to our client’s traumatic experience.
Impact on Family Life
The events that our client experienced did not just affect her; it had a ripple effect on her family. The trauma put strain on her relationship with her partner and impeded her ability to bond with her first child, causing her to feel immense emotional stress at an already vulnerable time in her life. Our client felt she hadn’t been able to bond with her newborn properly because of her concerning health and her worries surrounding that.
Our client had to spend hours away from her baby over multiple days before they finally addressed her condition.
Closure and Moving Forward
What our client experienced emphasises the critical need for compassion and competency in maternity care in the UK. Poor care provider actions and interactions have been identified as a major risk factor for experiencing birth trauma. A traumatic birthing experience is known to have lasting emotional effects for women and their families. Appreciating the mother’s experience and allowing her to feel seen is crucial for their mental wellbeing in the post-partum stage. A good level of care within a maternity setting includes providing sufficient information, respect for the individual, and engaging in positive interactions.
Comment from the client:
“As a first time mum, I hoped my first experience of labour and birth would be the best experience of my life, however giving birth at Pinderfields Hospital was absolutely horrific. The lack of care and compassion I received was disgusting and I wouldn’t wish any mum to go through what I did. After numerous attempts with other solicitors, I was told I did not have a case. However, Fletchers Solicitors were absolutely amazing, they thoroughly listened to me, fought my corner and helped me to find closure on the whole ordeal. I couldn’t thank them enough.”
Pinderfields Hospital initially denied this case. However, with our help, our client received a compensation of £3,800. While no amount of money can undo the trauma she suffered, this has provided her with a sense of closure. Pinderfields Hospital’s acknowledgment of their negligence and their apology allowed our client to begin the healing process and move forward with her life and her family.
Our client wanted to publicise her story to raise awareness about the importance of proper maternity care. By sharing her experience, she hopes it will push for improved standards of care and prevent future incidents.
Reflecting on the case Lawyer Amy Blakeney commented:
“I feel passionate about helping women who have suffered traumatic births, where hospitals have failed them. To be able to guide my client through this and hear her go on to experience a positive birth story after this one was truly lovely. Everybody should be entitled to a positive birth experience.”
