“I managed a claim that was proceeding through the Motor Insurers Bureau (MIB) as part of the untraced driver scheme. The claimant was filtering through traffic when a passenger in the third party’s car opened the door, resulting in a collision. The MIB were holding our client 50% responsible as they stated he had placed himself in a position of danger by filtering. We appealed the decision stating the client should hold no liability, quoting rules from highway code and referring to case law.  Upon review by the arbitrator they agreed with us and our client was awarded 100% of the compensation.”
