“In one case I dealt with last year we were acting for the Defendant. The circumstances were that the Claimant had pulled to the left hand side of the road and our client was passing on the right, when the Claimant turned across our client’s path, attempting to perform a U-turn. There were no witnesses, police reports or CCTV coverage available and it appears to be one person's word against the other. We therefore made a 50/50 split liability offer.

The client then disclosed an image of the Claimant’s vehicle parked up after the accident which supported a finding that the Claimant had indeed performed a U-turn, opening the door to an allegation of Fundamental Dishonesty. We withdrew all previous offers and we won 100% and the client was awarded additional damages.”
